Welcome to Hé Fēn Mahjong (the "App"), operated by Kojent Partners ("we", "us" or "our").
By downloading, accessing or using the App, you agree to these Terms of Use and End User License Agreement (the "Terms"). If you do not agree to these Terms, please do not use the App.
We grant you a limited, personal, non-exclusive and non-transferable license to download and use the App on compatible devices that you own or control, solely for your personal, non-commercial use and in accordance with these Terms and the applicable rules of the Apple App Store or Google Play Store. All rights not expressly granted to you are reserved.
You must be at least 13 years old, or the applicable minimum age required in your country to use the App independently.
If you are below the age at which you may enter into these Terms on your own, you may only use the App with the permission and supervision of your parent or legal guardian.
The App offers an optional auto-renewable subscription that removes advertising ("Remove Ads"), which may be available in monthly and yearly plans. The applicable price and billing period will be displayed before you complete your purchase.
Subscriptions automatically renew for successive billing periods unless cancelled in accordance with the applicable Apple App Store or Google Play subscription settings. Payment and renewals are processed by Apple or Google, as applicable.
You may manage or cancel your subscription through the subscription settings for the relevant platform.
Deleting the App does not cancel your subscription.
Any free trial or promotional offer, if available, will be subject to the terms displayed when you subscribe. Refunds are handled in accordance with the applicable Apple or Google policies and applicable law.
You may submit or upload content through the App, including mahjong images, rules, documents, corrections, score reviews, comments and other information ("User Content").
You retain ownership of your User Content. You grant us a worldwide, non-exclusive and royalty-free license to host, process, reproduce, transmit and otherwise use your User Content as reasonably necessary to provide, operate, maintain and support the App, including through our service providers.
Certain User Content may also be used to improve the App, including its tile-recognition and scoring systems, where permitted under our Privacy Policy and, where required, with your consent. You may withdraw such consent in accordance with the Privacy Policy.
You are responsible for the User Content you submit and confirm that you have the necessary rights to provide it and that its use in accordance with these Terms does not infringe the rights of any third party.

You must use the App lawfully and responsibly.

You must access and use the App only through its intended functionality and interfaces.
The App may recognise mahjong tiles and calculate or assist with scoring, including by applying rules or rule documents selected or submitted by you. Although we aim to provide accurate results, tile recognition, scoring, rules interpretation and results may contain errors.
Results are provided for convenience and entertainment purposes only. Users remain responsible for verifying scores and applying the relevant mahjong rules.
The App is not intended to facilitate gambling and does not itself award money or prizes.
Except for User Content, the App and all associated software, artwork, graphics, characters, designs, trademarks, features and other content are owned by us or our licensors and are protected by applicable intellectual property laws.
No rights are granted to you except for the limited license expressly provided under these Terms.
You may not copy, reproduce, distribute, sell, license or commercially exploit any part of the App except where expressly permitted by us or applicable law.
The App may rely on or interact with third-party services, including services provided by Apple, Google, Firebase, Google AdMob, RevenueCat and other technology or service providers.
Your use of certain third-party services may also be subject to the relevant provider's terms and privacy policies.
We are not responsible for third-party services to the extent permitted by applicable law.
We may suspend, restrict or terminate your access to all or part of the App if you materially breach these Terms, misuse the App, engage in fraudulent or harmful activity, create a security risk, interfere with other users, or where suspension or termination is reasonably required by law or to protect the App, us or other users.
You may stop using the App at any time.
Termination does not affect any rights or obligations that arose before termination. Provisions which by their nature are intended to survive termination will continue to apply.
To the maximum extent permitted by applicable law, the App is provided "as is" and "as available", without warranties or guarantees of any kind, whether express or implied.
We do not guarantee that the App will always be available, uninterrupted, secure or error-free, or that tile recognition, scoring, results or other functionality will always be accurate.
To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, special or consequential loss arising from or relating to your use of the App.
Our aggregate liability arising out of or relating to the App or these Terms will not exceed the amounts paid by you for the App or subscriptions during the twelve months preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability where such liability cannot lawfully be excluded or limited.
These Terms are governed by the laws of the United Arab Emirates. Subject to any mandatory consumer rights or laws applicable to you, the courts of Dubai, United Arab Emirates shall have jurisdiction over any dispute arising out of or in connection with these Terms or the App.
We may update these Terms from time to time to reflect changes to the App, our services, applicable laws or third-party technologies.
Where appropriate, we will notify you of material changes through the App or our website. The effective date at the top of these Terms shows when they were last updated.
Your continued use of the App after updated Terms become effective constitutes acceptance of the updated Terms, to the extent permitted by applicable law.

These Terms are between you and Kojent Partners only, and not with Apple Inc. ("Apple"). We, and not Apple, are solely responsible for the App and its content.
Your license to use the App is limited to a non-transferable license to use the App on Apple-branded products that you own or control and as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions, except that the App may also be accessed and used by other accounts associated with you through Family Sharing, volume purchasing or other features permitted by Apple.
We are solely responsible for providing any maintenance and support services relating to the App as required under applicable law or these Terms. Apple has no obligation to provide maintenance or support services for the App.
To the extent any warranty applies to the App and has not been effectively disclaimed, you may notify Apple if the App fails to conform to that warranty. Apple may refund the applicable purchase price of the App, if any. To the maximum extent permitted by applicable law, Apple has no other warranty obligation in relation to the App. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility.
We, and not Apple, are responsible for addressing any claims by you or a third party relating to the App or your possession or use of the App, including product liability claims, claims that the App fails to comply with applicable legal or regulatory requirements, and claims arising under consumer-protection, privacy or similar legislation.
If a third party claims that the App or your possession or use of the App infringes that third party's intellectual property rights, we, and not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
You represent and warrant that you are not located in a country that is subject to a United States Government embargo or that has been designated by the United States Government as a "terrorist supporting" country, and that you are not listed on any United States Government list of prohibited or restricted parties.
You must comply with applicable third-party terms when using the App.
Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
If you obtained the App through Google Play, your download and use of Google Play are also subject to Google's applicable terms and policies.
These Terms govern your relationship with us in connection with your use of Hé Fēn Mahjong. Where Google is responsible for processing a purchase, subscription, cancellation or refund, the applicable Google Play terms and policies will also apply.
